Terms & Conditions

1. Scope

These General Terms and Conditions (GTC) apply to the use of publicly accessible charging points for electric vehicles operated by Dayser Energy.

By starting the charging process, the user accepts these GTC.

2. Subject matter of the contract

(1) Dayser Energy provides publicly accessible charging infrastructure for charging electric vehicles.


(2) The contract between Dayser Energy and the user comes into effect when the charging process begins.


(3) The subject matter of the contract is the temporary provision of electrical energy for charging an electric vehicle.

3. Terms of use

(1) Use is permitted exclusively for electric vehicles with suitable charging infrastructure.

(2) The user is obliged to:

connect the vehicle properly

use only approved cables and connectors

vacate the charging area after completing the charging process

(3) The facility must not be used improperly.

4. Payment

(1) Payment is made directly at the charging point by debit or credit card (contactless or chip-based), unless otherwise specified.​

(2) No registration or app is required.

(3) The applicable price is displayed before charging begins.

 

(4) Billing is based on the amount of energy charged (kWh) and, where applicable, time-dependent components in accordance with the price list.

5. Pricing

(1) The prices published at the respective charging point apply.

(2) All prices include statutory value added tax.

(3) Additional fees (e.g. blocking fees after the end of charging) are shown transparently, if applicable.

6. Availability

(1) Dayser Energy endeavours to ensure a high level of technical availability of the charging points.

(2) However, uninterrupted use cannot be guaranteed.

(3) Maintenance work or technical malfunctions do not justify any claims for damages, unless there is evidence of intent or gross negligence.

7. Liability

(1) Dayser Energy shall be liable without limitation in cases of intent and gross negligence.

(2) In cases of simple negligence, Dayser Energy shall only be liable for breaches of essential contractual obligations (cardinal obligations).

(3) Liability is limited to foreseeable damage typical for this type of contract.

(4) Liability for damage resulting from injury to life, limb or health remains unaffected.

8. Behaviour at the charging point

(1) The user is obliged to observe local parking and usage regulations.

(2) Parking is only permitted during the active charging process.

(3) Dayser Energy reserves the right to take action in the event of misuse.

9. Data protection

Information on the processing of personal data can be found in the privacy policy on the Dayser Energy website.

10. Final provisions

(1) The law of the Federal Republic of Germany shall apply.​

 

(2) The place of jurisdiction shall be the registered office of Dayser Energy, insofar as this is legally permissible.

(3) Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions.
